Grandparent Rights
Colorado provides for grandparent custody rights in there has been a case concerning the children. Sometimes social services is involved and you need the help of an attorney. There is a presumption that it also within the child's best interest to have a strong relationship with the grandparents. The parents of either spouse can seek a court order from a Colorado court for reasonable grandparent visitation rights when there has been a child custody case or a case concerning the allocation of parental responsibilities. The guidelines of C.R.S.A. 19-1-117(1) will apply.
The court will generally allow grandparent visitation rights if it would be in the best interest of the child. (C.R.S.A 19-1-117(2). A skillful Colorado grandparent or other family lawyer should try to resolve the issue between the family members in effort to minimize heated cases. However, at times this is not possible.
