Bid Protest Overview 

  • As compared to the commercial world where you typically can not file a bid protest, the government allow you to have some legal recourse in the event that contract for which you submitted a bid, was incorrectly awarded to a competitor. If you are successful, the government bid protest rules allow you to collect protest cost from the government. GAO is typically the most frequent forum to file a protest. However, there are others depending on your specific case.What can you expect from GAO after you protest? GAO, as in most administrative law courts, has limited power. If the GAO determines that the bid award actions were improper, under 4 C.F.R. Section 28. 8(a) it can recommend that the agency.  1. Refrain from exercising options under the contract
    2. Terminate the contract
    3. Re-compete the contract
    4. Issue a new solicitation
    5. Award the bid (contract) consistent with the statute or regulation
    6. Such recommendations that GAO deems necessary Not all bid protests are brought before the GAO. Sometimes there may be a challenge to the awardee’s NAICs size. You will more than likely need an experience bid protest attorney that understands the rules.  After a contract bidder-usually a small business-wins a contract award, another bidder-usually a larger business-may challenge the ability of the contract winner to successfully perform the work without help from another contractor (the larger business, of course).  This is referred to as a size protest.
