Fathers’ Rights in General
Paternity in Colorado, once established, offers the father the same legal rights as a married father. The biological father can now petition a Colorado Court for child custody and will also be required to pay child support.
Paternity Proceedings: Under the Uniform Parentage Act (UPA) - C.R.S. §19-4-101, a child is presumed to be the child of the purported father if:
The child is conceived or born during the marriage (even if conceived before the marriage) or born within 300 days of the legal termination of the marriage. The presumption of legitimacy of a child born or conceived during the marriage is one of the strongest presumptions at law. There is a presumption of paternity if:
- The father receives the child into his home and openly holds the child out as his natural child.
- The father acknowledges his paternity in writing with the court or registry of vital statistics (birth certificate).
- Before the child’s birth, he and the child’s natural mother married or attempted to marry each other.
- Genetic testing (paternity test) shows that he is not excluded as the probable father and that the probability of his parentage is 97 percent or higher.
- A properly administered paternity blood test shows the probability to be 97% or higher that he is the father.
- The burden of proof is on the mother to establish paternity.
- Deception by the mother is no defense to a father’s paternity and child support obligations.
