Colorado Grandparent Rights Law
Under C.R.S. 19-1-117, a grandparent can petition a Colorado family law court for reasonable grandchild visitation if:
- The grandchild’s parents have been granted a divorce, annulment or legal separation
- The child has been placed in the legal custody of someone other than the parent, or
- The child’s parent has died (you must be the parent of the deceased parent)
- There has been a previously filed case involving the child
Grandparent visitation is not automatic. Sometimes, the parents may wish otherwise. However, the Colorado Court of Appeals still hold that grandparent rights are still strong in Colorado.
